By accessing, browsing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date and post the revised Terms on our website. Your continued use of our Services after changes become effective constitutes acceptance of the revised Terms.

You represent that you have the legal capacity to enter into a binding agreement and are not prohibited from using our Services under applicable law.

Our Services are not available to users in jurisdictions where the use of blockchain technology, cryptocurrencies, or our specific Services is prohibited by law. You are responsible for compliance with local laws regarding cryptocurrency and blockchain technology.

You represent that you are not:

• Located in, or a resident of, any country subject to comprehensive economic sanctions
• Listed on any government list of prohibited or restricted parties
• Acting on behalf of any person or entity described above

EVVO Network is a Layer 3 blockchain platform with AI-orchestrated consensus mechanisms. Our Services include:

• Access to information about EVVO Network and technology
• Interaction with EVVO smart contracts on supported blockchains
• Access to ecosystem products including Wallet, Swap, Bridge, and Staking (when available)
• Participation in governance (when available)
• Access to documentation and educational resources

EVVO Network operates as a decentralized protocol. Once deployed, smart contracts operate autonomously according to their code. We do not control and cannot modify transactions once they are submitted to the blockchain.

We do not take custody of your digital assets. You maintain sole control of your wallet and private keys. We cannot recover lost private keys or reverse transactions.

You are solely responsible for:

• Maintaining the security of your wallet and private keys
• All activities that occur using your wallet
• Safeguarding your recovery phrases and passwords
• Any losses resulting from unauthorized access to your wallet

You are responsible for verifying all transaction details before confirmation. Blockchain transactions are irreversible. We are not responsible for transactions sent to incorrect addresses or with incorrect amounts.

You agree to comply with all applicable laws and regulations in your jurisdiction, including but not limited to:

• Tax reporting and payment obligations
• Anti-money laundering requirements
• Securities regulations
• Export control regulations

You agree to provide accurate and complete information when using our Services and to update such information as necessary.

• Using our Services for any illegal purpose
• Engaging in money laundering, terrorist financing, or other financial crimes
• Violating any applicable laws or regulations

• Attempting to interfere with, disrupt, or disable our Services
• Introducing viruses, malware, or other harmful code
• Attempting to gain unauthorized access to our systems or user accounts
• Engaging in any activity that could damage, overload, or impair our infrastructure

• Engaging in fraud, manipulation, or deceptive practices
• Creating fake accounts or impersonating others
• Manipulating market prices through wash trading or other schemes
• Exploiting vulnerabilities in smart contracts for unauthorized gain

• Harassing, threatening, or intimidating other users
• Posting or transmitting harmful, offensive, or inappropriate content
• Violating the intellectual property rights of others
• Scraping or collecting user data without authorization

• Circumventing any access restrictions or security measures
• Using VPNs or other tools to bypass geographic restrictions
• Creating multiple accounts to evade bans or restrictions

EVVO and its licensors retain all rights, title, and interest in and to:

• The EVVO name, logo, and branding
• Our website design and content
• Our proprietary software and technology
• Documentation and educational materials

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes.

You may not:

• Copy, modify, or distribute our proprietary content without permission
• Use our branding in a way that suggests endorsement without authorization
• Reverse engineer our software or technology
• Remove or alter any proprietary notices

Certain components of EVVO may be released under open source licenses. Your use of such components is governed by the applicable open source license terms.

You retain ownership of any content you submit through our Services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with our Services.

Nothing in our Services constitutes financial, investment, legal, or tax advice. You should consult qualified professionals before making any financial decisions.

The $EVVO token and other digital assets involve significant risks, including but not limited to:

• Price volatility and potential loss of value
• Regulatory uncertainty and potential restrictions
• Smart contract vulnerabilities and technical failures
• Market manipulation and liquidity risks
• Loss due to hacking, theft, or operational errors

We make no guarantees regarding:

• The value or price of any tokens
• The availability or functionality of any services
• The success or completion of any roadmap items
• Returns on staking or other activities

You are solely responsible for determining and fulfilling your tax obligations related to your use of our Services and any transactions involving digital assets.

Smart contracts execute automatically based on their code. Once deployed, we cannot modify their behavior or reverse their executions.

We are not liable for any losses resulting from:

• Smart contract bugs or vulnerabilities
• Unexpected smart contract behavior
• Interactions between multiple smart contracts
• Blockchain network congestion or failures

While we conduct security audits, no audit can guarantee the absence of vulnerabilities. You acknowledge that smart contract interaction involves inherent risks.

You are responsible for understanding the smart contracts you interact with and the associated risks. We encourage you to review contract code and audit reports before interacting with any smart contract.

Our Services may contain links to third-party websites, services, or applications. We do not control and are not responsible for third-party services.

Our ecosystem may integrate with third-party protocols, exchanges, or services. Your use of such services is subject to their respective terms and policies.

Links to or integrations with third-party services do not constitute endorsement. You access third-party services at your own risk.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that our Services will be uninterrupted, timely, secure, or error-free. We may suspend or discontinue Services at any time without notice.

We do not warrant that any information provided through our Services is accurate, complete, or current. You rely on such information at your own risk.

We do not warrant the security, functionality, or availability of any blockchain network. Blockchain networks are decentralized and not controlled by us.

The regulatory status of blockchain technology and digital assets varies by jurisdiction and is subject to change. We make no representation regarding the legal status of our Services or tokens in any jurisdiction.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVVO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Loss of digital assets or tokens
• Business interruption
• Cost of substitute services

WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF:

• The amount you paid us in the 12 months preceding the claim, or
• One hundred U.S. dollars ($100)

THE LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Before initiating any formal dispute resolution, you agree to first contact us at legal@evvo.network and attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days.

If informal resolution is unsuccessful, any dispute arising from or relating to these Terms or our Services shall be resolved through binding arbitration, except as otherwise provided herein.

Arbitration shall be conducted:

• On an individual basis (not as a class action)
• By a single arbitrator
• In accordance with the rules of a recognized arbitration institution
• In English

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.

The arbitration agreement does not apply to:

• Claims for injunctive or equitable relief
• Claims related to intellectual property infringement
• Claims that may be brought in small claims court

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

You may stop using our Services at any time. Certain obligations under these Terms survive termination.

We may suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. Reasons for termination may include:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Request by law enforcement or government authority
• Discontinuation of Services

Upon termination:

• Your license to use our Services terminates immediately
• You remain responsible for any outstanding obligations
• Provisions that by their nature should survive termination will survive

We shall not be liable to you or any third party for any termination of your access to our Services.

These Terms, together with our Privacy Policy and any additional terms, constitute the entire agreement between you and EVVO regarding our Services.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or our right to enforce it later.

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

These Terms do not create any third-party beneficiary rights.

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, government actions, or internet or blockchain network failures.
